Changes for UK Student Visa Holders Switching to Work Visa Routes
In this blog post, we discuss recent changes to the rules for UK student visa holders who wish to switch to work visa routes. These changes, announced in the government’s Statement of Changes on 17th July 2023, impact students who applied after 3pm on this date for courses starting on or after 1st January 2024.
Work Visa Routes for Students
After completing their studies, students can switch to various work visa routes, including:
- Skilled Worker
- Graduate Trainee
- UK Expansion Worker
- Representative of an Overseas Business
- Global Talent
- High Potential Individual
- Innovator Founder
Previous Rules
Previously, students could transition to certain work visas before completing their courses if they had a job offer and met the requirements. This policy aimed to encourage international students to stay in the UK and contribute to the economy.
New Rules
Under the new rules, students must complete their degree-level courses before switching to a work visa. However, PhD students can switch to a sponsored work route 24 months after starting their course without completing their studies.
Reasons for the Changes
The changes address concerns about students using the student visa route for immigration purposes rather than education. The UK government aims to ensure that students’ primary purpose is to study, not work. The new rules reflect the government’s efforts to maintain the integrity of the UK’s education system and manage immigration effectively.
Working While Studying
Full-time student visa holders can still work while studying, with restrictions:
– Up to 20 hours per week during term time.
– Full-time during holidays and placements (not exceeding 50% of the course length).
– As a student union sabbatical officer for up to two years.
Students cannot work on permanent contracts, set up a business, or be self-employed.
Short-term Student Visa Holders
Short-term student visas are for English Language courses lasting 6 to 11 months. Holders of these visas cannot work in the UK, paid or unpaid, and cannot switch to other visa types while in the UK.
Conclusion
Students entering the UK on a student visa must prioritize completing their courses. While part-time work is allowed, their primary focus should be on education, reflecting their commitment to their studies and the UK’s educational standards.
